दिल्ली के शराब घोटाले मामले में कारोबारी समीर महेंद्रू को छह हफ्ते की अंतरिम जमानत
दिल्ली उच्च न्यायालय ने अब रद्द की जा चुकी दिल्ली आबकारी नीति में कथित अनियमितताओं से जुड़े धन शोधन के एक मामले में शराब कारोबारी समीर महेंद्रू को चिकित्सकीय आधार पर सोमवार को छह सप्ताह की अंतरिम जमानत दे दी। न्यायमूर्ति चंद्र धारी सिंह की अवकाशकालीन पीठ ने पाया कि आरोपी जानलेवा बीमारियों से पीड़ित था जिसके लिए तत्काल चिकित्सा और ऑपरेशन के बाद देखभाल की आवश्यकता थी। इसमें कहा गया है कि प्रत्येक व्यक्ति को पर्याप्त और प्रभावी उपचार पाने का अधिकार है। अदालत ने कहा कि जमानत देने के विवेक का प्रयोग केवल अंतिम उपाय के रूप में नहीं किया जाना चाहिए, बल्कि स्वतंत्रता एक पोषित मौलिक अधिकार है। “याचिकाकर्ता (महेंद्रू) को ट्रायल की संतुष्टि के लिए समान राशि की दो जमानत के साथ 10,00,000 रुपये (केवल दस लाख रुपये) की राशि में एक व्यक्तिगत मुचलका प्रस्तुत करने पर छह सप्ताह की अवधि के लिए अंतरिम जमानत दी जाती है। संबंधित न्यायालय, “अदालत ने आदेश दिया। अदालत ने कहा, “मनुष्य की स्वास्थ्य स्थिति अत्यंत महत्वपूर्ण है और स्वास्थ्य का अधिकार भारत के संविधान के अनुच्छेद 21 के सबसे महत्वपूर्ण आयामों में से एक है। प्रत्येक व्यक्ति को खुद को पर्याप्त और प्रभावी ढंग से इलाज कराने का अधिकार है।” कोर्ट ने निर्देश दिया कि महेंद्रू को तत्काल जेल से रिहा किया जाए। अंतरिम जमानत अवधि समाप्त होने के बाद, वह 25 जुलाई को शाम 5 बजे से पहले या इससे पहले निचली अदालत में आत्मसमर्पण करेगा। अदालत ने कई शर्तें लगाईं, जिनमें यह भी शामिल है कि वह अस्पताल और अपने घर की सीमा नहीं छोड़ेगा और देश भी नहीं छोड़ेगा। अदालत ने उल्लेख किया कि धन शोधन निवारण अधिनियम ने जमानत देने के मामलों में “बीमार या दुर्बल व्यक्तियों” को छूट दी और याचिकाकर्ता अपरिवर्तनीय होने की संभावना के साथ “बीमारियों की जीवन-धमकी प्रकृति” के कारण इस लाभ का हकदार था। याचिकाकर्ता को चोट”। “तथ्य यह है कि याचिकाकर्ता बैठने में असमर्थ है, आगे झुकने में सक्षम नहीं है, और यहां तक कि कोई वजन उठाने में भी सक्षम नहीं है, याचिकाकर्ता की ओर से दिन-प्रतिदिन की नियमित गतिविधियों को करने और सलाह और विशेष का पालन न करने की दुर्बलता का सुझाव देता है। उपचार से याचिकाकर्ता को न्यूरोलॉजिकल क्षति हो सकती है,” अदालत ने कहा। “याचिकाकर्ता की चिकित्सा स्थिति, बेदाग आचरण के साथ युग्मित और सह-आरोपी को नियमित जमानत देना ऐसे कारण हैं जो इस अदालत के लिए याचिकाकर्ता को विशेष उपचार प्राप्त करने के लिए अंतरिम जमानत देने के लिए पर्याप्त हैं,” यह कहा। अदालत ने यह भी कहा कि यह दिखाने के लिए रिकॉर्ड में कुछ भी नहीं था कि आरोपी ने उसे दी गई पिछली अंतरिम जमानत का दुरुपयोग किया और वह फरार भी नहीं पाया गया। अभियुक्त के लिए वरिष्ठ अधिवक्ता विकास पाहवा पेश हुए और कहा कि वह जानलेवा बीमारियों से पीड़ित थे और 5 बार अस्पताल में भर्ती हुए थे और पिछले 60 दिनों में उनकी 4 चिकित्सा प्रक्रियाएँ हुई हैं। प्रवर्तन निदेशालय ने कहा कि याचिकाकर्ता की हालत स्थिर पाई गई है और उसका दर्द काफी कम हो गया है और इस तरह वह मेडिकल जमानत पर बढ़ने का हकदार नहीं है। अभियोजन पक्ष के अनुसार, आरोपी कथित रूप से आबकारी नीति के उल्लंघन के प्रमुख लाभार्थियों में से एक था क्योंकि वह न केवल एक मादक पेय निर्माण इकाई चला रहा था बल्कि अपने रिश्तेदारों के नाम पर कुछ खुदरा लाइसेंस के साथ थोक लाइसेंस भी दिया हुआ था।
